Important Steps to Protect Yourself and Your Rights

- Stay calm, and ensure the safety of all involved. If there are no life-threatening injuries and you need to move your vehicle out of traffic to a safer spot, do so safely with your hazard lights on.
- Call 911 and report the accident. If you are in pain, stunned, dazed, bleeding, or feeling hurt in any way, then tell them you want an ambulance. If the ambulance crew says you should go to the hospital, follow their advice.
- Respectfully exchange contact and insurance information with the other driver. Take pictures of the other driver’s license, registration, and insurance card. Do not accept offers to “take care of it” with cash – they could still file a claim against you later, and you might miss out on necessary funds for medical expenses. If the other driver refuses to provide their information or begins to leave the scene, take a picture of their license tag.
- If you are able to get out of the car, take photos of the property damage and the positions of the vehicles on the roadway. If there are any witnesses, try to get their name, phone, and email address for later reference. If your phone can take video, you may wish to record these statements with the witness’ permission.
- After giving your report to the police, drive your vehicle home if you can do so safely, or have it towed. Sometimes your insurance will cover towing expenses.
